Terms and Conditions of the internet-based ticket sale for the Marketing Festival event, by the company Marketing Festival s.r.o.
I. The company Marketing Festival s.r.o., based in Renneská třída 393/12, Brno-639 00 Brno, IN 01646486, VATID CZ01646486, registered in the Commercial Register, kept by the Regional Court in Brno, Section C, File 78922, represented by Ing. Jindřich Fáborský, MSc., hereinafter referred to as "Company", issues these Terms and Conditions. Terms and conditions regulate the sale of tickets to the educational event Marketing Festival, held on 20th – 22nd October 2016 in Ostrava.
I. The company makes through its website a call for proposals for a contract of purchase of the tickets to the above specified educational event. Article § 1732 of the law no. 89/2012 Coll., Civil Code (hereinafter “NOZ”) shall not apply.
II. The person interested in buying the tickets (the "Applicant") submits an order through the Company's web interface, accessible from the website www.MarketingFestival.cz, as an offer for a contract of purchase of the tickets for the above specified educational event (hereinafter the "ticket order").
III. By ordering the tickets the Applicant accepts these Terms and Conditions and the conditions specified on the website www.MarketingFestival.cz. These terms are part of the content of the contract according to § 1751 sec. 1 NOZ.
IV. The purchase agreement for the ticket sale is concluded by the acceptance of ticket order by the Company, namely by sending an e-mail with the Company’s confirmation to an e-mail address provided by the Applicant in the ticket order.
V. Considering the character and the price of the event, the Applicant is considered to be a professional and is not considered to be a consumer according to § 419 NOZ. Therefore the consumer protection provisions, especially § 1810 and following, shall not apply.
VI. The price of purchase shall be paid online (by credit/debit card) or by wire transfer (on the base of invoice). Payment is due within 14 days from the date of invoice.
I. The price of the ticket is progressive according to an amount of tickets sold:

|first 500 tickets||225 EUR|
|501st – 1000th ticket||280 EUR|
|1001st – and further tickets||340 EUR|
The Company is subject to the VAT. Tax rate on the object of sale is 21 % in the Czech Republic. If the Applicant is a foreign subject, tax rates and other conditions follow the Directive 2006/112/EC.
II. In case of the Applicants inability to attend the event, the Applicant is entitled to a refund in the amount of 80% of the price paid only when informing the Company of such situation not later than on the 30th of September 2016. After this date, the price paid for the ticket is not refundable and only change of the participant can be done under the provisions of Article IV. II of these Terms and Conditions.
III. Included in the ticket is the time limited right to access the internal database of event’s video-records.
IV. Included is also the right to purchase of a ticket to each of the workshops that are held during the event. Details and ticket price of each workshop shall be published on www.MarketingFestival.cz and in its newsletters. The amount of tickets to each of the workshops is limited. After the capacity of each workshop is exhausted, the right to purchase of a ticket to this workshop is forfeited without any compensation.
V. In case of cancellation of the event, the Applicant is entitled to a full refund.
I. For the purpose of ordering the ticket, it is necessary to state and send all the data needed for ticket reservation and to pay the appropriate amount according to the instructions of the ordering system.
II. The ticket is tied to the participant, the natural person, as stated by the Applicant in the ticket order. Participant can be changed upon request, but not more than twice. The change of the participant can be performed free of charge until 18th of October 2016.
I. By personal information is meant an information about the participant, by which he or she can be identified directly or even indirectly. The Company collects and keeps personal information provided by the participant in a secured data centre. The Company declares that it protects the personal information of the participants in accordance with the law no. 101/2000 Coll., on the protection of personal information, as subsequently amended. Applicant hereby agrees with processing of his personal information.
I. If any of the provisions of this Terms and Conditions become invalid, validity of the rest of the provisions remains intact.
II. These Terms and Conditions come into force on 29th of March 2016.
III. By the termination of the contract is not affected validity of any other provisions of the contract, which should be expressly or by its effects in force after the termination of the contract.
IV. These Terms and Conditions are written in English and Czech language. For interpretation of these Terms and Conditions in case of a difference in the language versions, the Czech version is binding.
I. The Company's obligations to the Applicant, as well as any claims against the Company are limited to a time frame of one year.
II. The Company reserves the right to amend the content of these terms, especially the ticket price.
III. If any provision included in the Terms and Conditions become invalid, void, voidable or inapplicable, the most similar provision shall be applied. The invalidity or unenforceability of one provision shall not affect validity of the other provisions.
IV. Any and all matters in dispute between the Parties shall be governed by, construed, and enforced in accordance with the laws of the Czech Republic. Parties to this agreement settled on hearing disputes which may arise in connection with the legal relationship based on these Terms and Conditions in front of Czech courts.
